Distance Sales Agreement

This Distance Sales Agreement is entered into between the Seller (Eymence LLC) and the Buyer when a Kutlava paid plan is purchased online (at a distance). By completing the payment step you accept this agreement. The consumer laws of your country may grant you additional rights. This English text is provided for information; the Turkish version prevails.

Buyer
The user who creates an account on Kutlava and purchases a paid plan. The Buyer's name, email and billing details are those provided at purchase.
2. Subject of the Agreement
This agreement sets out the parties' rights and obligations regarding the sale and provision of the digital service that the Buyer orders electronically through Kutlava, whose features and price are stated below.
3. Service Features and Price
Kutlava is a QR-based digital memory-album service. Paid plans are offered as one-time purchases and are not subscriptions:
- Event plan: advanced album features for a single event; time-limited retention.
- Forever plan: advanced album features for a single event; indefinite archive.
The applicable price, currency and any taxes are shown clearly in the order summary and on the payment (Stripe) screen. Prices may be shown in different currencies depending on the Buyer's country; what binds the Buyer is the amount confirmed on the payment screen.
4. Payment
Payments are taken through the secure payment provider Stripe. The Buyer's payment card details are processed directly by Stripe; the Seller does not see or store them. The order is formed when payment is approved, and the Buyer is notified electronically.
5. Performance and Delivery
The service is digital and involves no physical delivery. Once payment is approved, the relevant plan features are activated in the Buyer's account immediately. Performance occurs when the service becomes available in the Buyer's account.
6. Right of Withdrawal
For intangible digital content and services performed instantly online, the statutory right of withdrawal may, under many countries' laws, no longer apply once performance has begun with the consumer's consent. Nevertheless, independently of any such limitation, Kutlava voluntarily grants an unconditional refund right within 30 days of purchase. The consumer laws of your country may grant you additional rights, which are reserved.

7. General Provisions
- The Buyer accepts having read and electronically confirmed the preliminary information (the service's essential features, price, payment and performance details).
- The Buyer is deemed to have accepted Kutlava's Terms of Service and Privacy Policy.
- If the Seller cannot perform its obligations due to force majeure, it will inform the Buyer and refund the amount paid.
8. Dispute Resolution
This agreement is governed by the laws of the State of Wyoming, United States, excluding its conflict-of-laws rules, and the state and federal courts located in Wyoming have jurisdiction over disputes arising from it. This does not affect any mandatory, non-waivable rights that a Buyer who is a consumer may have under the laws of their country of residence, nor their ability to bring a claim before the competent consumer bodies and courts there. The Buyer may send complaints and requests to [email protected].
9. Entry into Force
This agreement is formed and enters into force when the Buyer confirms the payment step electronically.
