Terms of Service

These Terms of Service govern your use of Kutlava (kutlava.com). By creating an account or using the service, you accept these terms. If you do not accept them, please do not use the service. This English text is provided for information; the Turkish version prevails.
1. Parties and Scope
These terms are entered into between Eymence LLC (“Kutlava”, “we”), which provides the service, and the natural or legal person using it (“User”, “you”). They cover the parties' rights and obligations relating to the provision of Kutlava's QR-based digital memory-album service.
2. Definitions
- Account Owner: a user who opens an account and creates an event album.
- Event: the celebration an album belongs to (wedding, engagement, birthday, corporate event, etc.).
- Guest: a person who scans an event QR and adds photos, videos, voice or written messages to the album.
- Content: any media and text uploaded to the service by the owner or guests.
3. Service Description
Kutlava lets an account owner create an event album; lets guests add content without installing an app or signing up; and manages content through an approval queue, visibility rules and a live memory wall. Visibility works in three modes: a live mode where everyone sees approved content, a delayed mode where guests see only their own uploads until a set moment, and a private mode where guests always see only their own content. The account owner always sees all content.
4. Account and Eligibility
- To open an account you must be 18 or older and have the legal capacity to contract.
- You are responsible for the accuracy of the information you provide and for the security of your account (including your password).
- You are responsible for all events and content under your account.
5. Plans and Payment
Kutlava offers a free plan and one-time paid plans: the “Event” plan and the “Forever” plan with an indefinite archive. Paid plans are not subscriptions; they are one-time purchases. Payments are taken through Stripe. Prices may be shown in different currencies depending on your country.
Kutlava may grant full-featured complimentary (free) accounts to friends or partners at its discretion. See the Cancellation & Refund Policy for refunds and the Distance Sales Agreement for the purchase contract.
6. Content and Responsibility
- You represent that the content is yours or that you have the right to share it, and that it does not infringe third parties' copyright, personality or privacy rights.
- The account owner is responsible for providing the necessary notices and permissions for collecting the images and voices of people attending their event.
- Kutlava does not guarantee the accuracy, suitability or legality of content; content is the responsibility of the person who uploads it.
- Rejected content is not announced to the guest; it drops from sharing but remains in the guest's own view.
7. Acceptable Use
When using the service you agree not to:
- Upload content that is unlawful, obscene, hateful, threatening or harassing, or that infringes third parties' rights,
- Share images or audio that violate others' privacy without their consent,
- Take actions that harm the service, breach its security, overload it, or abuse it through automated means,
- Infringe intellectual property rights or use the service for unlawful purposes.
8. Intellectual Property
You retain ownership of the content you upload. To provide the service (to store, process, generate previews of and display your content in the album), you grant us a limited, worldwide, royalty-free licence restricted solely to operating the service. The Kutlava brand, logo, software and design belong to Kutlava and may not be used without permission.
9. Content Moderation and Removal
Kutlava reserves the right to remove content it considers to breach these terms or applicable law, and to suspend accounts where necessary. Uploaded images may pass a lightweight AI pre-screen running on the guest's device; this can only route content to the owner's approval and performs no automatic deletion.
10. Service Availability and Changes
We strive to provide the service without interruption, but temporary outages may occur due to maintenance, updates or causes beyond our control. We may make reasonable changes to improve or modify the service's features.
11. Limitation of Liability
To the extent permitted by applicable law, Kutlava is not liable for indirect, incidental or consequential damages, or for loss of data or content. We recommend keeping a separate backup of your content. In any case, Kutlava's total liability shall not exceed the amount you paid for the relevant event.
12. Termination
You may close your account at any time. In the event of a material breach of these terms, Kutlava may suspend or terminate your account with or without prior notice. On termination, the retention provisions of the Privacy Policy apply.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-laws rules. The state and federal courts located in Wyoming have jurisdiction over disputes arising from these terms. This does not affect any mandatory, non-waivable rights that users who are consumers may have under the laws of their country of residence, nor their ability to bring a claim before the competent consumer bodies and courts there.
